ICE Ramps Up Warrantless, Legally Dubious Arrests — ProPublica

At the end of January, Gregorio’s brothers just started traveling on the road, collecting wooden pallets when federal officers dragged them into the suburbs of Chicago. Johnny and Bayron were in the same car. Mark’s third brother was driving separately, in another car behind them.

After Johnny Gregorio passed his identification, the officer with the immigration and customs execution opened the door and pulled it out. More than a dozen other officers arrived soon. Gregorio saw that they also stopped his brother Mark.

All three lived and worked in the US without permission after arriving with Guatemala. No one had a criminal record. But Bayron Gregorio received an order for deportation. Instead of detaining only it, the authorities took into custody all three brothers.

An attempt to fulfill the obligations for deportation of millions, Trump administration turned to tactics that caused a flurry of court problems across the country and created an atmosphere of fear. Each week, he brought a new example when agents detained immigrants and transferred them from the country to Guantanamo Bay; Gentlemen; And, most recently, a dangerous prison in Salvador without hearing, and even more opportunities to communicate with lawyers and relatives.

But in Chicago and other cities there are quiet operations that raise similar legal issues when federal agents gather people in those two and three.

Johnny and Mark Gregorio’s lawyers claim that their arrests were at least 22, which violated the court’s settlement, which forbade the authorities to detain the undocumented people with whom they coincide by following the warrants for others. The so -called preferences were the subject of class settlement in 2022, which outlined the tougher parameters for how agents should fight these situations, including new restrictions on unnoticed arrests.

Trump administration’s lawyers denied allegations that the arrests had been violated by the Nava Agreement after one of the original plaintiffs. In particular, the administration’s lawyers claimed that the arrests were not guaranteed, according to the court records.

According to the Nava settlement, ice agents must follow strict recommendations to make guarantees, including establishing that someone will try to escape rather than participate in the trial.

“The administration’s approach to the implementation of immigration and the way he replied to the rulings of the court was to become a canar in the coal mine of the total approach of this administration to our democracy and the rule of law,” said Mark Fleming, deputy director of court proceedings at the National Center Nava settlement.

Observers and supporters say they do not expect the White House to abandon their repression or to establish their tactics with any legal appeals.

“I don’t think they retreat,” said Kathleen Arnold, a professor at refugee university and forced migration studies. “They believe that it was not appropriate, which could prevent the ice to do exactly what they want.”

Neither ICE nor the Homeland Security Department answered the comment requests.

During the initial volume in January, the administration made it clear that the arrests of the collateral were part of the strategy of forced implementation in Chicago and other cities of the sanctuary, where local law enforcement agencies refused to assist in the arrest of migrants. “There will be more posts in the cities of the sanctuary because they made us go to the community and find the guy we are looking for,” Tsar Khman, in an interview with television television, said on the border of the White House.

Baden’s national policy was adopted as a national policy as part of the Biden administration, lawyers said, but were abolished after Trump entered the post in January. The Agreement is in place in Illinois, Indiana, Kansas, Kentucky, Missouri and Wisconsin, all states covered by the Chicago office of the ICE, lawyers said. It should end in May.

This month, the lawyers of the National Immigrant and Aklo Justice Center and Illinois went to the Chicago court, citing Nava settlement and seeking an order to stop the federal government to set up orders in the field, covered their customers for bond costs and provides weekly reports on any guarantee. They also ask to release two customers who are determined in the lawsuit that are still being held.

Creating an argument that the ICR and internal security violate Nava’s settlement, lawyers for two Gregory’s brothers said Johnny and Mark clearly did not risk flying. They both live in the US for more than ten years and have a connection with Chicago and suburban Mawud where they live. Johnny Gregorio is married and has a baby born in the US

According to the lawyers, the only orders for them were written after the detention.

“The creation of a warrant after the fact does not cure the unconditional nature of these incidents,” the lawyers wrote for the plaintiffs, “and the training material for settlement specifically prohibits dependent on the post -administrative warrants to avoid the requirements for a guarantee.”

In the end, two brothers and most other migrants cited in the trial were released and were able to stay in the United States at least. Two of 22 are still in custody, and one was deported, the lawyers of the two propaganda groups said.

Johnny and Mark Gregorio are now facing an immigration affair that has seen them removed from the United States. The couple’s lawyers do not claim that the arrest of their brother Bayron was unfounded and he is not a party in the trial. It is unclear whether it was deported.

Among those who have been released are the 54-year-old Chicago Noriega man. He distributed a resume to the local business in search of a job when ICE staff appealed to him in January, a witness statement said in the latest Nava.

Before he had the opportunity to explain, Noriego said, the officers handcuffed him and transferred it into a minibus. And only after he had already been taken to the ice processing center and waited for several hours, the officers checked his wallet and realized that he was a US citizen.

Aroch-ORTEGA, 47 years old, which was also named NAVA, was also arrested in January. He just returned home, buying breakfast for his family when officers detained him in the house in Lyon, the suburbs of Chicago, where he lived with his family for the last 15 years.

The State Medical Council has evidence of this doctor hurting patients. This resumed his license – twice.

Federal agents searched for Aroch-Ortagi’s son. They did not find it, but took the archor -or -ori. In his statement, OROZCO-ORTEGA stated that he had no criminal history. Not in detail in his case, why the agents were looking for a son. OROZCO-OTTEGA lives in the US without permission.

His wife Yoland said he was not a criminal and is not admitted to release. “He has no vices, he is not involved in the drug, he goes to church,” she said, speaking through a translator at a recent press conference. “Is the crime early every day to support your family? I just don’t know.”

Fleming said the center continues to make examples of arrests that the firm is believed to show that arrests without guarantee.
