The Supreme Court struck a strike for women, their ability to choose their own doctor and the whole structure of civil rights protection today. During the voting 6-3 (who crashed on ordinary guerrilla lines), the court ruled that women from Medicaid could not choose their own doctor or sue their civil rights if the legislators of the republican states in the South Carolina were not approved.

This case is Medina v. Planned paternityare no About abortion – at least not as a legal affair. Since the adoption of Haida amendments back in 1976, federal funds, including Medicaid, cannot be used for abortion services. Amendment Hayda – one of the the worst laws we if -the -takenand consistent excuse For consideration of medical care as a political reading, but this case did not dispute. He also did not seek to abolish the Neolithun’s position of the Republican Court of Rights.

But this case is there all about an abortion as a political matter. All because in 2018 South Carolina passed a law stating that Medicaid funds cannot be used with any supplier also provides Abortion services even if the patient is not looking for abortion.

Planned paternity provides a lot of medical services to people who have nothing to do with abortion. This is the most important healthcare provider for poor women who are much more likely to be on Medicaid. South Carolina’s law was a direct attack on planned paternity for abortion services, but also an attack on poor women who need health care whose only crime is poor.

The plaintiff in this case Julie Edwards went to the planned paternity for general gynecological services. Edwards is a diabetic and increases the risk of pregnancy. She stated that the planned parenting not only provided care she needed, but also did so in “without opinion” … that, as I think, it could be quite difficult to find in the South Carolina. She sued the state from her law on parental parenting, accusing South Carolina of violating her civil rights in accordance with the 1983 section of the civil rights law.

In truth, Edwards did not even need to give reason why she preferred to doctors on paternity planning because the 1965 Medicaid law includes the provision of freedom of choice in its text. If the states accept Medicaid funds, they also need to “provide it … Anyone who is entitled to medical care (including medicines) can receive such assistance from any institution, agency, community, pharmacies or persons who have qualifications for the necessary services or services.”

Current Issue

Issue of July/August 2025

Read this language carefully. It does not say that “any institution, except for the planned parenting” or “only the institutions with which Jesus agrees.” This is a rule that provides the freedom to choose Medicaid recipients.

At least it was until the Supreme Court took it today. Neil Gorsuk’s justice, writing for 6-3 republican supercorns, ruled that the charter I just quoted was not “clear” or “clear” to support private right to sue if freedom of choice is violated. He wrote that the language in the Medicaid Statute, which guarantees the freedom of choice, does not actually create “human rights law” for freedom of choice. He said that if Congress wanted to create the right to choose his own doctor, it may have, but somehow not, although Congress literally says that people can get medical attention from “any“The Institute has received qualifications for the performance of services.

When people accuse Republicans of the Supreme Court of being going to justify their own politics benefits, this is what they mean. There is no read Medicaid Charter, which does not include freedom of choice. There is no legal analysis of the statute that does not include freedom of choice. No history of precedent interpretation of the Medicaid Charter, which does not include freedom of choice. There is no way to explain what the conservatives do here, except for servicing their own political program so as to break away from any logical or reasonable reading of the law and text of the Charter.

This political agenda again – this no just about abortion and no Almost about the Permanent War Republicans against women’s health. The agenda also provides for a permanent speech of the 1871 civil rights law, as well as deniding amendments to the reconstruction in an effort to convert this country into the Antebellum Times.

The version of the civil rights law of 1871 still fulfills the critical function in modern legislation as it includes private right to court. Section 1983. The Law is object This allows people to sue discrimination. Without this, there is no possibility of individual citizens to prosecute the government for violations of civil rights.

It is predictable that the Republicans on the site bent to get rid of the 1983 section or reduce it until nothing is protected. In MedicGorsuk is making a giant step towards it. The legal speech of his ruling is that Congress cannot create the right to sue the 1983 section, if it does not use “clear” and “unambiguous” language. And even if it turned out, as it was in the Medicaid law, Gorshu can simply refuse the obvious clarity of this language and ban it anyway. The result is that only Neil Gorsuk (and his republican friends) can say that “clearly” and what is not, and Gorshuk here proves that he can insert an artificial ambigu into any statute he does not like.

Such a discarding civil rights is that Kentadiai Brown Jackson’s Justice has secured in his disagreement. She wrote: “(T) it is a project to stop one of the great laws on the country’s civil rights … South Carolina asks us to come out (section 1983) to avoid responsibility for violating the rights of its Medicaid recipients to choose their own doctors. The court adheres to South Carolina.” I wouldn’t. “”

Three years passed as the court overturned Rooe v. Wade in Dobbs v.But the conservatives still use an abortion as a Trojan horse to reshape all their worst ideas about the country’s reshuffle in their white male image. Here, in the event that not even about the abortion, the republican judges managed to pick up freedom of medical choice for poor women, limit Medicaid efficiency and deprive private right to sue discrimination and civil rights. They did all this because South Carolina passed a law aimed at planned paternity, the law that was supposed to be excluded in different ways unconstitutional in the previousOak the environment when it was transferred. And, almost like the appearance of their terrible goals, they managed to dissuade any medical facility, hospital or clinic from abortion services so that they also start from Medicaid.

This case is a terrible and great example of why the Return of Control over the Supreme Court should be the first priority for the Democrats if they allow them to own the authorities again. Civil rights in this country cannot survive the loss of civil rights law. The rights of women in this country cannot survive the magical abilities of Neil Grzukha inserted ambiguity into any charter in which indigenous Americans are not involved. And the right to abortion, “restored” or otherwise … can not survive the republican power in the Supreme Court.

If you are a direct white man, congratulations. If you are anymore, this Supreme Court has for you.
