The Menendez brothers are one step closer to potentially getting out of jail … because the Los Angeles County District Attorney just filed paperwork formally asking a judge to impeach them.
DA: George Gascon filed the motion just minutes ago … asking the judge to commute the brothers’ sentences from life without the possibility of parole to the possibility of parole. Because of the time served, this would allow them to be released immediately from prison.

It’s a long document… but it’s basically what the MoD office says Eric: and: Lyle have been decent prisoners and are no longer a threat to public safety, so there is no reason to keep them locked up.
The DA points to programs such as Erik’s Life Care and Connections, which provides support to disabled and elderly inmates, and VIVE. dedicated to victim impact and compassion involving one or both of the brothers, showing how the DA feels they have spent time and effort to make their prison community a better place.
They also list Eric’s and Lyle’s disciplinary records … showing they were written just eight and five times, respectively, during their more than 30-year incarceration.
The DA also mentions their ages…saying that not only were they young when they killed their parents, but they are now over 50, so the likelihood of committing another crime is greatly reduced.
Not all victims of the brothers’ crimes do well when they get out, the DA says, citing the brothers’ uncle who doesn’t want them released. However, the DA says many other family members have advocated for their release, which should be considered.
Gascon announced that he would advocate for Eric and Lyle’s release Earlier today … saying the two have paid their debt to society. The court hearing is scheduled for the end of November.
Despite this offer, Menendez’s legal battle is far from over … and could be further complicated by people working in the LADA office, who Gascon says could oppose this lawsuit in a future court case.
