The video shows Robert Brooks – an inmate serving a 12-year sentence for first-degree assault is repeatedly punched and kicked … and a man appears to tie him up with a towel.
Videos: published by the Prosecutor General’s Office show one officer repeatedly kicking Brooks in the midsection as the other officers hold him back.At one point, the officers lift Brooks up by his neck… his face is covered in blood and he can’t even support his weight.
According to the attorney general’s office, Brooks had a “use of force” encounter with correctional officers at the Mars Correctional Facility in New York on Dec. 9. He was taken to Utica’s Wynn Hospital, about 7 miles away, and died in the early morning hours of Dec. 10.

Commissioner of the New York State Department of Corrections and Community Supervision Daniel F. Martuscello III tells TMZ… “I was deeply repulsed and sickened by the video that took Robert Brook’s life. There is no excuse for this inhumane act that took a senseless life. This type of behavior cannot be normalized I will not allow it to happen within DOCCS.”
Martuchello says his department plans to investigate the tragedy on its own … promising institutional change.Of the changes already approved, Martuchello says 13 of those involved in the incident have been suspended and one has resigned.
The commissioner ends his comment by saying that this act was murder…and people will be held accountable for their actions.
