DiddyThe defense team is opposing the prosecution … accusing the federal government of unfairly spying on him while in continued detention.
In new court documents obtained by TMZ … the rap mogul’s legal team says the feds violated Diddy’s constitutional rights and hindered Diddy’s ability to fairly prepare for his upcoming trial behind bars.
The feds raided Diddy’s secret communications with his attorneys, lawyers say, once again calling into question the raid on the Bad Boy Records founder’s cell at MDC Brooklyn.
Diddy’s team claims the government worked with federal Bureau of Prisons (BOP) officials who monitored Diddy’s communications, including handwritten notes between him and an attorney … and say prosecutors then used some of that material to argue for the release. Didi was released on bail.
Diddy’s attorneys say a specific employee took photos of the notes and sent them to prosecutors in the case … and they say the government organized the prison cleanup under the false pretense of security concerns.
They also call how the person who raided Diddy’s cell even obtained the highly-debated records … saying the material wasn’t stored in Diddy’s bunkhouse, as prosecutors previously claimed. Rather, Diddy’s team says the A-lister kept the documents in his closet … apparently poked holes in the prosecution’s version of how they monitored the records.
This update comes 2 weeks after Diddy’s team scored their first major legal victory when a judge ruled in November that the prosecution must: “get rid” of copies of records … at least until the court hearing, when he could formally decide whether they could be used at trial.
Diddy — who was it? arrested and charged in September on charges of racketeering conspiracy, sex trafficking and transportation for prostitution; tried and failed to secure bail 3 times… this raid played a big part in the last hearing.
A spokeswoman for the Southern District of New York declined to comment.
