The jury has started deliberating subway chokehold death trial of Daniel Penny.
The jury — made up of seven women and five men — is deliberating whether to convict Penny of manslaughter and criminal negligence in the death of Jordan Neely, a 30-year-old homeless man, on a New York City subway train.
In sentencing, prosecutors told the jury that Penny’s use of deadly force must have been unjustifiable and that Penny acted recklessly and knowingly ignored the substantial risk of suffocating Neely for so long. Defense lawyers told the jury that Penny was trying to protect subway passengers.
Defense attorneys also argued that Penny never intended to kill Neely, while prosecutors did not have to prove that Penny intended to kill Neely for the jury to return a guilty verdict.
